The High Court in Accra has ordered the Attorney General’s Office to take over all criminal prosecutions currently before the courts from the Office of the Special Prosecutor, declaring the OSP’s ongoing cases void.
Justice John Eugene Nyadu Nyante ruled that while the OSP retains its investigative mandate, it cannot independently prosecute criminal cases without express authorisation from the Attorney General under Article 88(4) of the 1992 Constitution.
The decision followed a legal challenge to the OSP’s prosecutorial authority. The court awarded costs of GH¢15,000 against the anti-corruption body.
The judgment effectively suspends all OSP-led prosecutions until the Office secures formal delegation of prosecutorial powers from the Attorney General.
